Town and Country Planning Act 1976 (Act 172)

Section 19. Prohibition of Development Without Planning Permission – No person, other than the local authority, shall commence, undertake, or carry out any development unless planning permission in respect of the development  has been granted to him under section 22 or extended under section 24 (3).

Street, Drainage and Building Act 1974 (Act 133)

Section 70. Notice of New Buildings – No person shall erect any building without prior written permission of the local authority.

Upon erecting of a building without prior approval of the local planning authority (LA), a fine of not more than Five Hundred Thousand Ringgit (RM 500,000.00) or imprisonment for a term not exceeding two (2) years or both and in the case of a continuing offence to a further fine which may extend to five thousand Ringgit (RM 5000.00) for each day during which the offence continues after the first conviction of the offence

Any person who continues to carry out any development after being required to discontinue it is commits an offense and is liable to a fine not exceeding One Hundred Thousand Ringgit (RM100,000.00) or imprisonment for a term not exceeding six (6) months or to both and to a further fine which may extend to Five Thousand Ringgit (RM5,000.00) for each day during which the activity is so continued after the first conviction of the offence.
